Who is the rightful owner of the term 'iCloud'?

Inc. has been sued by iCloud Communications for trademark infringement. The Phoenix-based company stated that their customers were confused on whether they were owned by or not.

According to i iCloud Communications’ legal papers, “Apple’s announcement and launch of its ‘iCloud’ cloud computing service appears to be just one more example of Apple’s ‘act first and worry about the consequences later’ approach to trademark use. Even the most cursory Internet search — which could have easily been conducted by any of the legion of Apple’s in-house marketing or legal staff — would have revealed the prior, long term usage of the iCloud Marks by iCloud Communications.”

However, some experts are saying this is impossible since Apple has been working on iCloud for the past five years and has trademarked the name in Sweden.

No official statement was given by Apple about this dispute. ABC News did a little research of their own and did not find any proof that iCloud Commmunication owns the right for the term ‘iCloud’.
